Daily overtime by state
California, Alaska and Nevada add overtime after 8 hours in a workday, and Colorado after 12. Nevada's daily rule covers only workers paid under $18.00 an hour. For any other state, this page applies the federal rule and doesn't include that state's own rules.
Of these states, only California requires double time: after 12 hours in a workday, and after 8 hours on the seventh day in a row.
Which breaks count as hours worked
Short rest breaks, from 5 to about 20 minutes, count as hours worked. A meal break of usually 30 minutes or more, when you're fully off duty, doesn't count toward the 40 hours.
